Hi, all, thank You for reading this. I was wondering if it allowable to build one's own games based on Tremulous on Id tech 3 or some other engine. What am exactly wondering is it legal and if it is do I need a permission from the developers to do so. Also, what does one need to become a member of the Tremulous dev team?

Is Tremulous trademarked? I think it is, meaning that you can't call anything tremulous without permission, and you're not likely to attain it until you have something working that looks good.
However, the source code is under the GPL and the assets are under some form of Creative Commons, which means you don't need permission to freely use those to make a game under certain conditions (most importantly, that if you redistribute a derivative work of the source code, you must publish that source code).

I don't recall ever having seen mention of a trademark, and a cursory search of the US and UK trademark databases doesn't turn up anything.

A trademark as any name you trade under, so (assuming its eligible) it would be.
Those databases are *registered* trademarks. Registration isn't required to be a trademark, but AFAIK it's de-facto required if you want to enforce anything.

"trade under", i'm not sure trem's ever been traded, it'd be interesting to know how automatic trademarks work with respect to free software.

There's a donate button, the devs have made money, ergo trade.
But really the whole point is moot, it's not like anyone here has the cash or will to launch a lawsuit. And I doubt Warbane is planning to do anything to warrant one. So really we're a mile off topic.
Warbane: Read the GPL, you can use the code and assets as long as you give credit and your code is also GPL etc.
If it's a big change then change the name, like how trem isn't called Quake anymore.

Tremulous is based on IOq3, so if you don't have building and wall walk etc, then that may be a better fit.

So when you said 'based on tremulous' did actually mean you'll be using any of it's code/assets or just the concept?

So, i could make somthing like trem, just using hell different models and stuff, but similar ideas and call it 'a random game similar to trem on quake engine'?

The code and assets have copyleft licenses you should adhere to. I don't know what statutes use of the name would fall under, but you should invent a new name anyway so no one gets confused. But you're free to liberally appropriate gameplay ideas for your own use as much as you want (pretty sure you don't need any kind of permission for that).
Also, what does one need to become a member of the Tremulous dev team?
Make a lot of consistently high-quality contributions until we decide to make you "official".

Use can "Tremulous" everywhere but it is better if you get the support of original creators of the title(like Nexuiz Console did)
