Title: To the developer for TREMULOUS
Post by: djronix on December 21, 2011, 05:00:45 am
It was a long time ago when I witness people who are eager to gain money based on others creation.

http://en.wikipedia.org/wiki/Tremulous
-------
Though Tremulous features a similar theme and game-play to Natural Selection,[7] the developers say it is neither based on it nor inspired by it. Development on the game began "long before NS was in the public domain".[6] The similarity in gameplay can likely be accounted for by the fact that the Tremulous team cite an earlier game as a possible inspiration, a Quake 2 mod called Gloom. Gloom may have had a similar impact on the development of Natural Selection.
------
If you read the entire wikipedia trumolus is saying that their not copying natural selection gamestyle.
If that is true about their not copying then can someone please explain for me what's this is doing in app store?

Jack Chavez, are you really behind this or is it some randome person who claims being you? Can you please explain why you've stolen their old rifle model which they had, the map texture and their hub?

I'm sorry for my behaviour, just that I'm very angry about this.

The app is not a part of the Tremulous project, and violates Tremulous licensing. The screenshot posted isn't even from the game. The guy who is selling it has done this for several other ioq3 games. He's kind of a dick, and the sooner his apps get taken off the store the better.

Perhaps a lawsuit is in order?  I'm no license expert but doesn't this clearly violate the GPL?

The GPL, if I remember correctly, allows for people to profit off GPLed projects, but the source must be made available (which it is, from this site). I hope I'm wrong.

I don't think even GPL allows people from taking someone else's work and pass it as their own, which this guy seems to be doing.

you cannot pass it off as your own, but you can sell it.  you do have to give proper credit, as well as make the source available.

if you wanted to, you could sell copies of any GPLed software.

Plenty of people sell GPL'd software, in the days before broadband ordering a CD was the cheapest way to get linux.

AFAIK if he gives credit, labels it as GPL and includes the source, then he's OK.
He's failing on the first two, no idea about the third.

Also the pic of the tyrant with sunglasses isn't part of the game, and I've never seen anyone mention it's under any sort of licence, so that's (probably) straight copyright infringement.

Also I guess the trademark could be used, but that would require darkleagon to hire a lawyer, so probably a no-go.

The price has increased to $2.99 and he removed the first screen shot, which was not part of Tremulous, but he still puts up the screen shot ripped from this site.  I think he may be monitoring this forum and trying to rake in more money before being pulled from the store.

Well, with CD, you are buying a physical media and labor used to make it, plus the shipping charges.

perhaps of interest, and quite relevant -
http://www.gnu.org/philosophy/selling.html

we all know ioq3 is gpl, and the trem specific content seems to be creative commons.  because of this, so long as the source code and license info is distributed, this guy seems to be within rights.

Hi,

If you buy the app from the store, you're entitled to:

A verbatim copy of the GNU GPL which states your usage/distribution rights.
A copy of the FULL sources (not just diffs) to the binaries you 'bought'.

The author of the app must make the sources available as a download OR be willing to ship them on other media for a reasonable fee, for as long he is distributing the binary.

Well... looks like I'm (fortunately) wrong. Price is back down to $0.99, by the way, but the screenshot is from the actual game.

Chavez, if you're reading this, eat all the dicks. Thank you.

All of this misunderstanding of the GPL aside, this is an entry on the Mac app store, i recall a great deal of fuss about certain requirements on programs sold from said app store to restrict the user's freedom in ways that are fundamentally incompatible with the GPL.
Long and short, you _can_ sell a GPL'd game, no problem there*, you can't, unless something's changed that i'm not aware of, sell it in the mac app store, it's against apple's terms and conditions.

*assuming the whole game including data is gpl'd, this is rarely actually the case with games that use ioq3 and i'm fairly sure trem's no exception.
