Is it legal to payless use Q4 engine on Tremulous?

First, it is the Doom 3 engine, not the Quake 4 engine. It just so happens Quake 4 uses that engine, but it was actually developed for Doom 3.
Second, it has already been suggested and people said it would be a really bad idea.
Third, in another 6 or 7 years (or less if there are some major advancements over the next year or two), Id will probably release the source code for the engine under the GPL.

1. The DOOM3/Q4 engine is currently proprietary software, and will require a license from ID software if the trem devs want to distribute it.
2. The use of such an engine will exclude many tremulous players who don't have the necessary hardware to run it.
3. There are other open-source quake-based engines that can provide more eye-candy, these include darkplaces, evolutionQ3 and tenebrae amongst others.
4. Engine porting is a huge task.

engine is called quake4 engine even before the release of doom3 it was called quake4 engine.

you can port it to q4 but you will need to buy q4 and play trem as a mod

What about the Unreal Engine 2?
Free (well, you need to buy the game), good and easy to use.

What about Doom 3? The game is in bargain bin and the engine is as capable as the one of Quake 4 ;)
And there's even a good Thief type mod coming for it!

I predicted even before the release of Doom 3 that its engine would be referred to incorrectly as the Quake 4 engine.
Unfortunately, the Id site is down now and archive.org is remarkably slow. So all I have is this (http://en.wikipedia.org/wiki/Doom_3_engine). Note that Quake 4 engine (http://en.wikipedia.org/wiki/Quake_4_engine) redirects there.

its an idiot, close but not quite.
Quake 4 does have the same engine but its more optimised and can do outdoor spaces, whereas Doom3 struggled if it wasn't in a room.
If they want to be silly they could try Cube 2 :D

Bah, no need to be aggressive like that. First, if they really use the same engine, it doesn't prove wrong the fact that Doom 3 is as capable as Quake 4. Second, I very very very doubt both games use the same engine version.

There are currently available alternatives for a Doom3-like rendering which Tremulous could use with very few coding changes (in short, Trem in real time lighting is easy to achieve). This would mean that all the textures would have to be redone to have normal maps, and that half of the current players would have to quit playing Trem (even computers which handled Doom3 might have troubles cause Trem gameplay puts way more models on screen at the same time, and Trem maps have a much more complex architecture than D3 maps).
I'm not in the dev team, so I have no clue what's their vision on this topic, but I guess Trem will someday be per pixel lit, but not before a few years.

My theory is that Quake was really just a long experiment in good engine development, but that Doom is really what id likes. Doom 3 is a remake of the original Doom (I could see myself doing the same thing if I liked my first idea but the result wasn't as good as it deserved). Quake 4 wasn't developed by id.

My fact is that anyone even remotely suggesting that Tremulous can easily be ported over to the DOOM3 should read up on both engines and then come back here to say they were wrong and actually pretty stupid.

Well... some cvars are still the same and they are both based on OpenGL... ;)

Yes. D3 is written in C++, Q3 is written in C, so there is no Q3 code in D3. Although the way some of the D3 engine works was derived from Q3.
@Neo: Trem on the sauerbraten (http://sauerbraten.org/) engine? Well.... at least mapping is easier ;)

One this is porting to D3 engine and another thing is porting to a quake3 based engine with D3 quality rendering. As I said, giving Tremulous the visual quality of Doom 3 is not only possible at the moment, it is also easy (code-wise).

Nah, Bungie is going to release the Halo engine in a few years, and trem should use it.
