I just noticed on a local trade auction site that someone is selling
this game .

Im just wondering if this is allowed at all see following link

I dont know if the following is tremulous ( havent played it yet ) does anyone recognise it buyer initialy mentioned a connection with qfusion after i questioned
the buyer it dissapeared from the description

Yes they are allowed to sell it under the GPL:

There are certain caveats (have to include the source, etc)i'm sure other people know of better than I do, but this isn't the first time someone has done this.

And whether the seller is taking advantage is up to the person buying the game. The seller mentions "a professionally bundled CD package" which combined with shipping might be enough to make you pay for it. The only shady thing i could tell would be that the person didn't mention the tremulous website :P

Hmm, well if someone put together a Trem + Backport + all the maps, that'd be FTW for slow connection users / non-backport users as long as they didn't charge too much.

The trem engine is release under the GPL, but the art is under the creative commons license which means if a single artist denies your right to sell, then it's illegal.

Can't he simply say that what he is selling is the package and not the game itself? In other words, might someone just sell a bunch of Trem maps, and say that he is including the client so that the customer can use the maps?

"simply"? No. Too many licenses are involved.
But he can sell the package including the game if he decides he just wants his production costs reimbursed.
As soon as he makes any profit he might be in deep shit, depending on the licenses :)

All the Trem 1.1 media content is under the commercial creative commons license, which means all the artists have already agreed that it's alright.

User made maps, on the other hand, have their own licenses, so if a person wanted to sell a bundle of Trem plus user made maps, then they would need permission from all the individual artists.  Otherwise, you're free to sell Trem it as you want, as long as the source is included.
