Hungarian Tesco selling Tremulous for money!?!
« on: May 04, 2008, 09:28:01 pm »
*** Pics soon as I get to upload them from my friends phone. ***

We just saw Tremulous boxed and on the selves in a Tesco hypermarket here in hungary for 1990HUF - they are takeing money for freeware.
I'm also thinking of sending a mail to the 'national consumer-protection authority' (don't know how to properly translate the name of 'Nemzeti Fogyasztóvédelmi hatóság' so pls  get over it...) and to a well known blog that is themed around these sort of mischiefs...
Am I stupid or this is the proper action take (as a shocked and appalled customer) ?

yeah they made...

So technically it is legal for them to sell Tremulous? Some GPL expert could show up here :-[

Quote from: http://www.gnu.org/licenses/gpl-faq.html#DoesTheGPLAllowMoney
Does the GPL allow me to sell copies of the program for money?
Yes, the GPL allows everyone to do this. The right to sell copies is part of the definition of free software. Except in one special situation, there is no limit on what price you can charge. (The one exception is the required written offer to provide source code that must accompany binary-only release.)

Does the GPL allow me to require that anyone who receives the software must pay me a fee and/or notify me?
No. In fact, a requirement like that would make the program non-free. If people have to pay when they get a copy of a program, or if they have to notify anyone in particular, then the program is not free. See the definition of free software.

The GPL is a free software license, and therefore it permits people to use and even redistribute the software without being required to pay anyone a fee for doing so.

But also..

Quote from: http://www.gnu.org/licenses/gpl-faq.html#DoesTheGPLAllowMoney
Can I release a modified version of a GPL-covered program in binary form only?
No. The whole point of the GPL is that all modified versions must be free software—which means, in particular, that the source code of the modified version is available to the users.

I downloaded just the binary from the net. If I distribute copies, do I have to get the source and distribute that too?
Yes. The general rule is, if you distribute binaries, you must distribute the complete corresponding source code too. The exception for the case where you received a written offer for source code is quite limited.

I want to distribute binaries via physical media without accompanying sources. Can I provide source code by FTP?
Version 3 of the GPL allows this; see option 6(b) for the full details. Under version 2, you're certainly free to offer source via FTP, and most users will get it from there. However, if any of them would rather get the source on physical media by mail, you are required to provide that.

If you distribute binaries via FTP, you should distribute source via FTP.

And please.. pics! :P

So legally they are ok if they have the sourcecode available on their disks or they give a working link for you to download it from - but technically they are selling a program that is freely downloadable and only playable online... ::) It's still worthy for that blog.  :D

Pics as soon as my friend gets home and uploads them on his pendrive and get's back to my place tomorrow same time as today...  8) So be patient. I don't have bluetooth and he doesn't have net. :(

£6.22 - seems cheap, however anyone who doesnt like the idea could piss Tesco off some if they're not providing the source code on the CD, by requesting they send it in the mail free as an extra :P

Too bad hungarian security guards are just thugs in uniform... They'd beat me into a pulp for it until I give in and buy all the boxes I wrote on... :(

The boxard is kind of lame... The rear is traditional text with screenshots. As soon as I get the pictures I'll upload them and give a full translation of the text :D

I assume only the Hungarian Tesco? Because the Tesco hypermarkets in Malaysia are not selling any kind of video games.
I'm a developer for the following projects(now I'm inactive) :

TremWars's Client and Server Executable

"The software moulds fps with certain strategy elements. Some of the players are builders who build the base and defend it. They are responsible for the upgrades (lol wut??) and they provide a safe place to respawn. The fighters must defend their bases or attack their enemies.

The game can be played on the internet and on LAN with other players. (no shit Sherlock?!) Players can choose from the human and the alien race."

Exact translation for you ;D
